For many, the decision to pick a daycare is one of the toughest ones they will make in their child’s early years. From agonizing over the staffing to the cleanliness of the location, parents expect that the thought and care they placed in their decision to be reflected by the staff. Especially because the most important thing in that parent’s life – their little boy or girl – has been entrusted to someone who holds themselves out as a caring and competent child care professional. However, sometimes no matter a parent’s best intentions, a child gets hurt at daycare. The question then becomes what to do next.

Take photos and video of your child’s injury

 Luckily, most injuries children undergo heal and are forgotten to time. However, the medical bills, time away from work, and emotional toll are not as easily forgotten. Make sure to take photos and videos of your child’s injury from every possible angle and be as detailed as possible. Document the date and time the photos and videos were taken in addition to any and all information about the injury. Speak to your child about the injuries and the occurrence and write down everything your child says in addition to noting his or her emotional state.

Seek medical treatment as soon as possible

Even if the daycare was negligent, that does not mean you should be negligent as a parent. You should quickly seek any necessary medical attention for your child in due course. This will also establish that you did not worsen your child’s injury by inaction on your part, thus making liability more difficult to determine.

As you do this, you should ensure to keep all medical bills and receipts associated with medical care from doctors’ bills to costs incurred in buying medicine and transporting your child to and from necessary medical appointments. In this case, it is more helpful to your attorney if you keep every possible receipt to ensure you are reimbursed for the costs due to you.

Consult an experienced attorney

After you have ensured your child has received the medical treatment he or she needs, you should consult an experienced attorney familiar with personal injury law. He or she can work with you to compile evidence, demonstrate negligence by the daycare, and ensure that you get the monetary compensation you need to make you and your child whole again.   1. My niece got hurt at her daycare recently and after reading this article it would be best
    if we consult an attorney ASAP.

  2. My child has never been injured at daycare but they don’t tell me about anything unless there is a visible mark or bruise. So that lessens the anxiety for me since I don’t have to worry about it. They also let me know if my son is doing anything that might hurt another kid.
