Before Governor Pritzker signed House Bill 219 on August 11, 2023, Illinois was one of the 16 minority states that did not allow punitive damages in wrongful death cases. Now, for the first time in the State of Illinois, the estate of decedents can seek punitive damages under the Wrongful Death and Survival Acts. 1 (740 ILCS 180/1, 740 ILCS 180/2) and Survival Act (755 ILCS 5/27-6) Black’s Law Dictionary defines Punitive damages as ‘having the character of punishment or penalty; inflicting punishment or a penalty.”
